The U.S. 8th Circuit Court of Appeals has upheld the child pornography conviction and 23-year sentence for a Sioux City man also serving federal prison time on drug and firearms convictions.
Kevin McManaman was sentenced last year after pleading guilty to two counts of producing child pornography for making sex videos of an underage girl.
In his appeal, McManaman said that agents looking for drugs and guns in his house came upon a locked box that contained the child porn. He says because the box did not contain drugs or guns, the
evidence found in it should not have been allowed.
But the federal appeals court agreed with the lower court that because the incriminating nature of the evidence was immediately apparent to officers, they were entitled to seize it.
